Suspected DWI Crash Kills 1 in Dallas

Just after midnight on April 19, 2022, two people traveling in a Nissan Titan pickup truck hit a tree near Woodall Rodgers Freeway in downtown Dallas. The passenger of the truck was declared dead at the scene. The driver of the truck was taken to the hospital for minor injuries.

The driver is being charged with intoxicated vehicular manslaughter and a firearms crime. No other vehicles were involved in the crash.

DWI Accidents Often Result In Death Or Catastrophic Injuries

When a person operates a vehicle under the influence of any substance, they place themselves and others at risk. An intoxicated driver does not have the decision-making skills or reflex times necessary to operate a vehicle safely.

Sadly, many Dallas car accidents resulting from DWI result in death or catastrophic injuries to the people involved.

What is even more frustrating about these car accidents is that they all could have been avoided.

This Accident Resulted In Wrongful Death

The passenger in the above accident lost their life as a direct result of the accident. The surviving family members may be entitled to seek compensation under wrongful death because of this accident. It will be important to speak with a Dallas personal injury lawyer about the event.

Not all members of the surviving family have the right to seek compensation. This is why it is very important to speak with a personal injury attorney about the accident.

While your personal injury lawyer understands that filing a compensation claim for wrongful death will not help with the emotional pain from losing your loved one, it can help with the financial strain. A family dealing with the emotional loss of wrongful death should not have to also worry about covering the bills or putting food on the table.

Types Of Compensation Available For Wrongful Death

Qualified surviving family members may be entitled to receive different types of compensation for wrongful death. Some of these may include:

  • All medical expenses related to the death
  • Funeral and burial expenses
  • Pain and suffering
  • Loss of companionship and loss of services

In this case, the court may also award punitive damages. Punitive damages are rare, but they do happen. The court awards these damages to punish the responsible party for their actions and hopefully discourage them from preparing the same actions. Since DWI is illegal, punitive damages may be part of the claim.
